2. Use of the website
You agree to use the website lawfully and respectfully. In particular, you must not:
- Use the website in any way that violates applicable law or regulation.
- Attempt to gain unauthorised access to any part of the website, related systems or networks.
- Probe, scan or test the vulnerability of the website, or breach its security or authentication measures.
- Interfere with or disrupt the website or the servers or networks connected to it.
- Use the website to send unsolicited communications, promotions, advertisements or spam.
- Misrepresent your identity or impersonate any person or entity.
We reserve the right to suspend or terminate access to the website for anyone who violates these terms or who otherwise uses the website in a manner we reasonably consider harmful.
3. Intellectual property
Unless stated otherwise, all content on this website — including text, graphics, logos, images, video, audio, code and the design and arrangement of the content — is the property of Happy Ship or its licensors and is protected by copyright, trademark and other intellectual-property laws.
You may view, download and print content from the website for personal, non-commercial reference, provided that you keep all copyright and other proprietary notices intact. Any other use (including reproduction, modification, distribution, republication or public display) requires our prior written permission.
The Happy Ship name and logo are trademarks of Happy Ship. Nothing on this website grants you any right or licence to use them without our permission.
4. User submissions
When you send us content — for example, a message through the contact form, an email or a project enquiry — you give us permission to use that content only as reasonably necessary to respond to your enquiry, discuss your project and provide any services you request.
You confirm that you own or have the necessary rights to anything you submit, and that your submissions do not infringe the rights of any third party.
5. Third-party content and links
The website uses or may contain content from third parties, including Google Maps, Google Fonts and Cloudflare Turnstile. We do not control and are not responsible for the content, policies or practices of these third parties. Your use of third-party content is subject to the relevant third party's terms and policies.
6. Disclaimer of warranties
The website is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy.
We do not warrant that the website will be uninterrupted, error-free or secure, or that defects will be corrected. We may modify, suspend or discontinue any part of the website at any time without notice.
7. Limitation of liability
To the maximum extent permitted by law, Happy Ship and its directors, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of (or inability to use) the website.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law (including liability for fraud, death or personal injury caused by negligence).
8. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Happy Ship and its directors, employees and partners harmless from any claim or demand (including reasonable legal fees) arising out of your breach of these terms or your misuse of the website.
9. Governing law and jurisdiction
These terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these terms or the website will be submitted to the competent court in the Netherlands, unless mandatory consumer-protection laws give you the right to bring proceedings in your country of residence.
10. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
11. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top reflects when they were last revised. Material changes will be highlighted on the homepage for a reasonable period. By continuing to use the website after changes take effect, you accept the revised terms.
